Preamble

「So-net検索ツールバー」(以下「本サービス」といいます)は、ソネットエンタテインメント株式会社(以下「弊社」といいます)が提供するサービスです。
本サービスをご利用いただく方は、So-net検索ツールバー利用条件(以下「本条件」といいます)を必ずお読みのうえ、ご同意ください。

本サービスのうち、Internet Explorer版については以下のソフトウェアが含まれて(バンドルされて)います。本サービスのうち、当該ソフトウェア部分に関する利用条件については、それぞれのソフトウェアのライセンスに基づき利用者に許諾されます。なお、当該ソフトウェアの利用条件については、本条件の文末に記載の「第三者ソフトウェアに関する利用条件について」をご確認ください。

本サービスのうちFirefox版については、GNU Lesser General Public License Version 2.1(LGPL)に基づきライセンスされるライブラリが含まれています。Firefox版に関する注意事項については、本条件の文末に記載の「Firefox版について」をご確認ください。

第1条(定義)

本条件における「利用者」とは、本条件に同意のうえ、本サービスを利用する方をいいます。

第2条(使用許諾)
  1. 弊社は、本サービスをダウンロードしインストールした利用者に対し、本条件に定める条件に従い、本サービスの譲渡不能かつ非独占的な使用権を許諾します。
  2. 本サービスの著作権その他一切の権利は、弊社または当該権利を有する第三者に帰属します。
  3. 本サービスのバージョンアップが行われた場合、バージョンアップされた本サービスについても本条件が適用されるものとします。
第3条(禁止事項)

利用者は、以下の行為を行うことは出来ません。

  1. 他の利用者、第三者または弊社の著作権、その他の知的財産権を侵害する行為。
  2. 事実に反する情報を送信・掲載する行為、または情報を改ざん・消去する行為。
  3. 本サービスまたは第三者が管理するサーバ等の設備の運営を妨げる行為。
  4. 本サービスに関し、修正、変更、改変、リバース・エンジニアリング、逆コンパイル、逆アセンブル等する行為。
  5. 本サービスの全部若しくは一部に関して、第三者に対して販売、頒布、貸与、譲渡又はその他の処分を行う行為。
  6. 本サービスを本条件に規定される態様以外の態様で使用する行為。
  7. 前各号に定める行為を助長する行為。
  8. 前各号に該当する虞があると弊社が判断する行為。
  9. その他、弊社が不適切と判断する行為。
第4条(免責)
  1. 弊社は、本サービスの動作および内容について、その完全性、正確性、確実性、有用性等につき、いかなる保証も行わないものとし、本サービスの利用により生じた結果に対する一切の責任は利用者が負うものとします。
  2. 弊社は、本サービスの提供に関し、以下に定める利用者に生じた損害については一切責任を負わないものとします。
    1. 弊社の責に帰すべからざる事由から生じた損害
    2. 弊社の予見の有無に拘らず、特別の事情から生じた損害
    3. 情報の消失、毀損等による損害を含む、逸失利益
第5条(広告)

利用者は、利用者への通知なしに、本サービス上において、弊社および弊社の指定する者の広告が掲載されることに関し、予め了承するものとします。

第6条(本サービスの提供および中断または中止)
  1. 弊社は、理由の如何を問わず、利用者に事前の通知をすることなく、本サービスの全部または一部の変更、追加または廃止ができるものとします。
  2. 弊社は、次のいずれかに該当する場合、自らの判断により本サービスの全部または一部の提供を中断または中止することができるものとします。
    1. 火災、地震、洪水等の天災、戦争、動乱、騒乱等の事変、停電、労働争議、その他の非常事態が発生し、または発生するおそれがある場合。
    2. 本サービスに関連する弊社指定のサーバその他弊社が運用もしくは管理する設備の保守を定期的にまたは緊急に行う場合。
    3. 本サービスに関連する弊社指定のサーバその他弊社が運用または管理する設備、ソフトウェア等の異常、故障、障害その他本サービスを提供できない事由が生じた場合。
  3. 弊社は、前項各号の規定により本サービスの全部または一部の提供を中断または中止する場合、自らが適当と判断する方法で事前に本サービスのウェブページ上で告知するものとします。ただし、緊急の場合、弊社は、かかる通知または告知を行うことなく、本サービスの全部または一部の提供を中断または中止することができるものとします。
  4. 弊社は、本サービスの全部または一部の提供の中断、中止または廃止によって生じた利用者および第三者の損害につき、一切責任を負わないものとします。
第7条(権利義務の譲渡禁止)

利用者は、本条件に基づく権利または義務の全部または一部を第三者に譲渡し、または担保の目的に供してはならないものとします。

第8条(本条件等の変更等)
  1. 弊社は、弊社が利用者に対して、本サービスのウェブページ上で告知することにより、本条件を適宜変更することができるものとします。
  2. 利用者は、弊社に対して、前項の告知の日から起算して1週間以内に、弊社が別途定める手続に従い、本サービスを利用者のPCから削除しない限り、前項の変更について承諾したものとみなします。
第9条(準拠法)

本条件の成立、効力、履行および解釈に関しては、日本法が適用されるものとします。

第10条(協議・解決)
  1. 本条件の規定の解釈、又は本条件に規定なき事項について利用者と弊社との間に紛争または疑義を生じた場合、その都度両者誠意をもって協議解決するものとします。
  2. 前項による協議をしても解決できず、訴訟の必要が生じた場合、東京地方裁判所を第一審の専属管轄裁判所とします。

附則:この利用条件は2009年6月29日から実施します。

  • Firefox版については、本規約とLGPLの定めとの間に齟齬が生じた場合、本規約の条件はLGPLの定めに反しない範囲で適用されるものとします。

  2. 事実に反する情報を送信・掲載する行為、または情報を改ざん・消去する行為。
  3. 本サービスまたは第三者が管理するサーバ等の設備の運営を妨げる行為。
  4. 本サービスに関し、修正、変更、改変、リバース・エンジニアリング、逆コンパイル、逆アセンブル等する行為。
  5. 本サービスの全部若しくは一部に関して、第三者に対して販売、頒布、貸与、譲渡又はその他の処分を行う行為。
  6. 本サービスを本条件に規定される態様以外の態様で使用する行為。
  7. 前各号に定める行為を助長する行為。
  8. 前各号に該当する虞があると弊社が判断する行為。
  9. その他、弊社が不適切と判断する行為。
第4条(免責)
  1. 弊社は、本サービスの動作および内容について、その完全性、正確性、確実性、有用性等につき、いかなる保証も行わないものとし、本サービスの利用により生じた結果に対する一切の責任は利用者が負うものとします。
  2. 弊社は、本サービスの提供に関し、以下に定める利用者に生じた損害については一切責任を負わないものとします。
    1. 弊社の責に帰すべからざる事由から生じた損害
    2. 弊社の予見の有無に拘らず、特別の事情から生じた損害
    3. 情報の消失、毀損等による損害を含む、逸失利益
第5条(広告)

利用者は、利用者への通知なしに、本サービス上において、弊社および弊社の指定する者の広告が掲載されることに関し、予め了承するものとします。

第6条(本サービスの提供および中断または中止)
  1. 弊社は、理由の如何を問わず、利用者に事前の通知をすることなく、本サービスの全部または一部の変更、追加または廃止ができるものとします。
  2. 弊社は、次のいずれかに該当する場合、自らの判断により本サービスの全部または一部の提供を中断または中止することができるものとします。
    1. 火災、地震、洪水等の天災、戦争、動乱、騒乱等の事変、停電、労働争議、その他の非常事態が発生し、または発生するおそれがある場合。
    2. 本サービスに関連する弊社指定のサーバその他弊社が運用もしくは管理する設備の保守を定期的にまたは緊急に行う場合。
    3. 本サービスに関連する弊社指定のサーバその他弊社が運用または管理する設備、ソフトウェア等の異常、故障、障害その他本サービスを提供できない事由が生じた場合。
  3. 弊社は、前項各号の規定により本サービスの全部または一部の提供を中断または中止する場合、自らが適当と判断する方法で事前に本サービスのウェブページ上で告知するものとします。ただし、緊急の場合、弊社は、かかる通知または告知を行うことなく、本サービスの全部または一部の提供を中断または中止することができるものとします。
  4. 弊社は、本サービスの全部または一部の提供の中断、中止または廃止によって生じた利用者および第三者の損害につき、一切責任を負わないものとします。
第7条(権利義務の譲渡禁止)

利用者は、本条件に基づく権利または義務の全部または一部を第三者に譲渡し、または担保の目的に供してはならないものとします。

第8条(本条件等の変更等)
  1. 弊社は、弊社が利用者に対して、本サービスのウェブページ上で告知することにより、本条件を適宜変更することができるものとします。
  2. 利用者は、弊社に対して、前項の告知の日から起算して1週間以内に、弊社が別途定める手続に従い、本サービスを利用者のPCから削除しない限り、前項の変更について承諾したものとみなします。
第9条(準拠法)

本条件の成立、効力、履行および解釈に関しては、日本法が適用されるものとします。

第10条(協議・解決)
  1. 本条件の規定の解釈、又は本条件に規定なき事項について利用者と弊社との間に紛争または疑義を生じた場合、その都度両者誠意をもって協議解決するものとします。
  2. 前項による協議をしても解決できず、訴訟の必要が生じた場合、東京地方裁判所を第一審の専属管轄裁判所とします。

附則:この利用条件は2009年9月15日から実施します。
